The 2024 Immigration Law in France : The Status of Algerians

In France, legislation relating to the rights of foreigners is compiled in the Code of Entry and Stay of Foreigners and the Right to Asylum, also called CESEDA. The issue of residence permits is therefore governed by the provisions contained in this code. However, residence permits for Algerians in France are governed by another text.
The case of Algeria is different: in fact, France and Algeria signed on December 27, 1968 an "agreement relating to the movement, employment and stay in France of Algerian nationals and their families", most often referred to as the “Franco-Algerian agreement”, which establishes a specific regime for Algerians wishing to enter France, settle there and work there. This initial agreement was subsequently modified and supplemented by 3 successive amendments: 1st amendment signed on December 22, 1985; 2nd amendment signed on September 28, 1994; 3rd amendment signed on July 11, 2001. This is why we often speak of the “modified Franco-Algerian agreement”.
