Medical Expertise in Algerian Social Security Legislation

The Algerian legislature recognises medical expertise as a mechanism for resolving medical disputes. This is achieved through the use of medical arbitration as a preliminary and mandatory procedure for internal dispute resolution, with the exception of disability cases, which are within the purview of the qualified disability committee. In this regard, the primary objective of medical expertise is to facilitate amicable resolution of disputes through straightforward and expeditious procedures. The legislator has stipulated that the results of the expertise are binding on the parties involved, with the exception of cases where the conduct of medical expertise is rendered impossible. The legislator has rendered the results of the aforementioned expertise binding on the parties to the dispute, except in one exceptional case, namely the impossibility of conducting the medical expertise.
